WOODLAND — The Yolo County District Attorney’s Office plans to re-try the case of a former UC Davis student accused of sexually assaulting a fellow student back in 2012.
The first trial of 25-year-old Lang Her ended last week with jurors voting 8-4 in favor of acquittal on felony charges of rape of a drugged victim and rape of an unconscious victim.
Deputy District Attorney Amanda Zambor said in court Thursday she plans to seek an amended complaint in the case charging Her with an additional count of felony sexual battery, based on testimony that emerged during Her’s eight-day trial as well as juror feedback.
A hearing on that issue is scheduled for June 18, with a second trial slated for the week of Aug. 10 before Judge Paul Richardson.
The alleged victim, referred to in court documents as “Y.X.,” filed a report with Davis police on July 11, 2012, saying she had fallen asleep at Her’s off-campus residence after consuming alcohol and awoke to find the defendant, who was an acquaintance, engaging in sexual conduct with her.
A warrant for Her’s arrest was issued in October 2013, and court proceedings in the case began the following April, according to Yolo Superior Court records.
Her, who is free on bail, has denied the allegations. He was voluntarily dismissed from UCD following his arrest after disobeying a no-contact order with the alleged victim, according to Zambor.
