Having allegedly violated his probation in a hit-and-run case, a Davis man was back in jail this week following two failures to show up in court and a second arrest on drug-related charges.
However, Brian Douglas Cassidy was scheduled to be re-released on his own recognizance sometime late Thursday, a Yolo County Jail spokeswoman said.
Cassidy, 60, was taken into custody Tuesday morning after police received a report of possible drug-related activity on Outer Circle in the Rancho Yolo mobile home community off Pole Line Road.
According to Deputy Police Chief Ton Phan, officers conducted a probation search on Cassidy and found him in possession of drug paraphernalia and alcohol, both violations of his probation terms. He already faced violation-of-probation charges in connection with an April 21 arrest for allegedly possessing heroin.
Initially jailed following the April arrest, Cassidy was released on his own recognizance, only to fail to show up for scheduled appearances in Yolo Superior Court on May 23 and again this past Monday. Following the May no-show, Judge David Reed issued a pair of warrants for Cassidy’s arrest.
His probation term stemmed from a Dec. 17, 2014, alcohol-related crash on Chiles Road in which Cassidy’s vehicle drifted into the oncoming lane and struck motorcyclist Nikolas Kostelny head-on.
Kostelny, of Davis, was badly injured in the collision but survived.
In addition to probation, Cassidy received a five-year, eight-month suspended prison term that could be reinstated as a result of the alleged probation violation.
Held on $70,000 bail following his Tuesday arrest, he apparently was granted a supervised released during his arraignment hearing Thursday despite objections from the Yolo County District Attorney’s Office.
