New charges possible for driver in Winters DUI crash

WOODLAND — The Yolo County District Attorney’s Office is seeking to add additional charges in the case of a Davis man accused of critically injuring his girlfriend in an alcohol-related Winters crash.

Nicholas Anthony Kershner, 30, already is charged with felony drunken driving causing injury in connection with the April 29 collision in which his truck, traveling 70 to 80 mph, jumped a curb and struck a pole on Railroad Avenue.

His girlfriend, 31-year-old Brooke Lindsay McNeill of Davis, suffered head trauma and internal injuries from the impact.

If approved at a Yolo Superior Court hearing later this month, a new complaint would add a second count alleging that Kershner had a blood-alcohol level of 0.188 — more than twice the legal limit of 0.08 — at the time of the crash, according to court documents.

It also would add enhancements to the charges reflecting Kershner’s high speed and the extent of McNeill’s injuries — she suffered brain damage and was placed in a medically induced coma as part of her treatment, court documents say — and would remove an enhancement accusing Kershner of refusing to submit a blood sample, which he did after refusing initially.

A hearing on the matter is set for June 14, the same day as Kershner’s scheduled preliminary hearing, in Judge Timothy Fall’s courtroom.

Kershner — whose bail at the Yolo County Jail was reduced from $1 million to $80,000 last month after it was determined that McNeill was expected to survive her injuries — is no longer in custody.
